Sarah Plant was diagnosed with Mesothelioma at 35. The cause of the deadly cancer, according to Plant, was the use of talc products containing asbestos. She had been using many of the products since childhood. Plant sued several companies in 2022 over the use of asbestos in their products.
In March 2023, a South Carolina jury ordered talc supplier Whittaker, Clark, & Daniels to pay Plant $29.14 million. The attorney for Plant, Jessica Dean of Dean Omar Branham Shirley, stated that the verdict was just, but she said she would have liked to have settled out of court. She continued by saying it takes time to go through a jury trial. It is hard for a client who may not have much time left. The attorneys for Whittaker, Clark, & Daniels did not comment on the case. Whittaker, Clark, & Daniels is no longer in business.
Plant also sued talc manufacturer IMI Fabi, but a jury did not find in favor of Plant. The jury determined that IMI Fabi was not responsible for Plant’s illness. They cleared IMI Fabi of any liability.
Two companies settled out of court instead of going to trial. The cosmetic company Mary Kay reached an agreement with Plant. Up to this point, Mark Kay had no claims against them regarding talc. The pigment maker Color Techniques also settled out of court.
Another defendant in the case was Johnson & Johnson. They moved their talc liabilities to a subsidiary that was in bankruptcy, so they were not part of the trial. Dean was hoping to have a chance to try the company.
